THESE TERMS LIMIT THE REMEDIES AVAILABLE IN THE EVENT OF A DISPUTE AND REQUIRE THAT ALL DISPUTES BE RESOLVED THROUGH BINDING ARBITRATION. THIS MEANS THAT YOU AGREE TO RESOLVE DISPUTES INDIVIDUALLY ACCORDING TO THE ARBITRATION PROVISIONS BELOW RATHER THAN IN A COURT OF LAW OR THROUGH A CLASS ACTION LAWSUIT.

Professional Qualifications and Scope
Our team includes a certified health coach and a registered dietitian. We provide health coaching services and nutritional guidance within the scope of these qualifications. While we have professional training in health coaching and nutrition, we do not provide medical diagnosis, treatment, or medical advice. We do not hold ourselves out to be Medical Providers (including doctor/physician, nurse, physician's assistant or any other medical professional) or Mental Health Providers (including psychiatrist, psychologist, therapist, counselor, or social worker). Our services are complementary to, not a replacement for, medical care.

Consult Your Physician or Health Care Provider
Our intent is NOT to replace any relationship that exists, or should exist, between you and your Medical Provider or Mental Health Provider. You should always seek the advice of your own doctor/physician, nurse practitioner, physician's assistant, Mental Health Provider, or another health care professional regarding any questions or concerns about your specific health situation. We advise you to speak with your own Medical Provider or Mental Health Provider before implementing any suggestions obtained through our Website, Programs, Products and Services including but not limited to exercise, lifestyle, weight loss, food, vitamins or supplements; engaging in an elimination diet, detox or cleanse; meditation or deep breathing exercises; or participating in any other aspect of a weight loss, healthy eating, exercise and/or lifestyle program. You shall not disregard professional medical advice or delay seeking professional advice because of information you have read on this website or received from us. You should not stop taking any medications without speaking to your Medical Provider and/or Mental Health Provider. If you have or suspect that you have a medical problem, you are advised to contact your own Medical Provider or Mental Health Provider promptly.

We are affiliated with JADE Supplements, which operates as a separate business entity. Any purchases or interactions with JADE Supplements are subject to their separate terms and conditions.


5. Payment Terms and Processing

Online Payments
You can purchase services on the Site. We accept credit and debit cards through Stripe and PayPal payment processing. If a credit card account is being used for a transaction, Plant Powered Health LLC d/b/a Type 2 Diabetes Revolution may obtain preapproval for an amount up to the amount of the payment.

Subscription Services
For subscription services like our monthly meal plan membership, all charges and fees will be billed automatically to the credit card you designate during the setup process on a recurring basis. If you want to designate a different credit card or if there is a change in your credit card, you must change your information online. This may temporarily delay your ability to make online payments while we verify your new payment information.

Payment Warranties
You represent and warrant that if you are making online payments that (i) any credit card, debit card and bank account information you supply is true, correct and complete, (ii) charges incurred by you will be honored by your credit/debit card company or bank, (iii) you will pay the charges incurred by you in the amounts posted, including any applicable taxes, and (iv) you are the person in whose name the card was issued and you are authorized to make a purchase or other transaction with the relevant credit card and credit card information.


6. Refund Policy and Guarantee

Our Guarantee
We offer a results-based guarantee for our coaching programs and online courses. If you are able to show no improvements in your blood sugar from the beginning of the program through completion of the full program, we will gladly issue you a full refund. Proof must be in the form of both glucometer readings and bloodwork done through lab testing that demonstrates no improvement in blood sugar levels.

Monthly Membership Refunds
Monthly meal plan memberships may be cancelled at any time, but no refunds will be provided for partial months. Cancellation will take effect at the end of the current billing cycle.

Refund Process
To request a refund under our guarantee, you must provide documentation of your blood sugar levels from before starting the program and after completing the program, including both glucometer readings and laboratory test results. All refund requests must be submitted within 30 days of program completion.


7. Cookies and Tracking
This website uses cookies. Cookies store information related to visitors' preferences, browser type, and other information in order to optimize their experiences. By using this Site you acknowledge your understanding of and consent to Plant Powered Health LLC d/b/a Type 2 Diabetes Revolution's use of cookies. Content Monitoring
We do not monitor the submission or publication of User Content on the Site and are not responsible for the User Content. We may remove, edit, or delete any User Content submitted, hosted, or stored on the Site or our servers without providing you with prior notice.

We record certain webinars, live events, and educational sessions within our online courses for the purpose of allowing participants to re-watch content or for those who cannot attend live to access the material later. By participating in any recorded session, you acknowledge and consent to being recorded.

Video Release
By participating in any recorded webinar, live event, or session, you hereby grant Plant Powered Health LLC d/b/a Type 2 Diabetes Revolution the irrevocable right and permission to record, edit, use, reproduce, distribute, and display your image, likeness, voice, and any materials provided by you in connection with these sessions (collectively, "Content") in any and all media now known or hereafter devised for educational and business purposes related to our Services.


11. Personal Responsibility and Assumption of Risk

Our Website, Programs and Services aim to accurately represent the information provided. You are acknowledging that you are participating voluntarily in using our Website, Programs and Services, and you alone are solely and personally responsible for your results. 17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PLANT POWERED HEALTH LLC D/B/A TYPE 2 DIABETES REVOLUTION, INCLUDING ITS SUBSIDIARIES, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, PARTNERS, SUPPLIERS, AGENTS, AND LICENSORS, MAY NOT BE HELD LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, IN NO EVENT MAY OUR AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (U.S. $100.00) OR THE AMOUNT YOU PAID US, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.


18. Indemnity
You agree to indemnify, defend, and hold harmless Plant Powered Health LLC d/b/a Type 2 Diabetes Revolution and its subsidiaries, officers, employees, contractors, agents, affiliates, partners, suppliers, and licensors, including, but not limited to, costs and attorney's fees, from any claim or disputes by a third party arising out of your use of the Site, violation of these Terms, violation of applicable law, or your posting, modifying, or otherwise transmitting User Content through the Site or Services.


19. Termination
We may suspend or terminate your access to the Site at any time and for any reason or no reason at all, with or without notice, at our sole discretion. Your User Content may also be deleted in the event your access is terminated. Where applicable, all rights and responsibilities of the parties under these Terms will survive the termination of this agreement.


20. Dispute Resolution
Unless both parties agree otherwise, you and Plant Powered Health LLC d/b/a Type 2 Diabetes Revolution agree that any dispute, claim, or controversy you may have arising out of or relating to the Site, Services, or these Terms will be resolved by binding mediation in the State of Delaware.

If binding mediation does not work, this case will escalate to mandatory binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules, and the judgment of its arbitrator(s) may be entered by any court of competent jurisdiction.

THE PARTIES AGREE THAT EACH IS WAIVING ITS CONSTITUTIONAL RIGHT TO A TRIAL BY JURY AS WELL AS THE RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION OR MULTI-PARTY ACTION. ALL CLAIMS AND DISPUTES RELATED TO YOUR USE OF THE SITE OR SERVICES OR ARISING UNDER THE TERMS MUST BE ARBITRATED OR LITIGATED ON AN INDIVIDUAL BASIS AND NOT ON A CLASS BASIS.

Any dispute, claim, or cause of action that you may have arising out of or relating to the Site, Services, or these Terms must be commenced within one year after the cause accrues; otherwise, such cause of action will be permanently barred.

Assignment
